Terms of Service

These Terms of Service ("Terms") govern your use of the Make an Offer service (the "Service") — a hosted widget and dashboard that lets visitors of your website submit price offers which you can accept, decline, or counter. By creating an account you agree to these Terms.

1. The Service

The Service provides: an embeddable offer widget served from our domain, a merchant dashboard for managing offers, card authorization and capture via Stripe on your connected Stripe account, transactional emails to you and your customers, and signed webhooks to systems you configure (for example, the WooCommerce plugin).

4. Card authorizations

Offer submissions place an authorization hold on the customer's card. Holds expire after approximately 7 days; the Service releases unactioned holds automatically before expiry. Captures, releases, and counter-offer charges are executed via Stripe and are subject to Stripe's availability.

5. Availability and changes

The Service is provided "as is" and "as available", without warranties of any kind. We may modify, suspend, or discontinue features with reasonable notice where practicable. We are not liable for lost sales caused by downtime of the Service, Stripe, or your own website.

6. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the platform fees you paid to us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including disputes between you and your customers.

7. Termination

You may stop using the Service at any time; removing the widget code or plugin stops new offers. We may suspend or terminate accounts that violate these Terms or create fraud, legal, or abuse risk. Upon termination, outstanding authorizations are released.
